Protection of your personal data

Preamble

CLAIR GROUP, in its capacity as Data Controller, is likely to collect and process personal data about you, particularly in the course of its activities, via the website of the various companies in the group, notably: www.astonfly.com.

CLAIR GROUP, as well as all the other companies in the group, undertakes to comply with the regulations applicable to all processing of personal data, in particular the French Data Protection Act of 6 January 1978 and the General Data Protection Regulation 2016/679 of 27 April 2016, which came into force on 25 May 2018 (known as the “GDPR”).

  1. Responsible for the collection and processing of site data

As data controller, we ensure that personal data:

  • Is processed lawfully, fairly and transparently;
  • Is collected for specified, explicit and legitimate purposes in accordance with the established processing register and is not further processed in a way incompatible with the specified purposes;
  • Are kept adequate, relevant and limited to what is necessary for the purposes for which they are processed;
  • Are accurate and kept up to date so that there is no inaccurate data.

The processing of your personal data is justified on different legal grounds depending on the purposes determined:

  • Consent obtained directly from the data subject;
  • The contract for the performance of a service;
  • Legal obligation for flight security, anti-terrorism or any other purpose deemed appropriate by the relevant authorities;
  • Legitimate interest to enable us to improve your passenger experience;
  • Safeguarding vital interests in the context of litigation and at the request of insurance companies.

All appropriate technical and organisational measures for the protection of personal data shall be taken to ensure a level of security appropriate to the risk inherent in the processing operations.

ASTONFLY staff are aware of the relevant internal procedures and respect the applicable data protection rules.

  1. Collecting personal data

Personal data is collected:

  • When processing your quote request,
  • When processing a request for information.

For all websites, personal data can also be collected by browsing the websites through tracers and cookies.

The fields mentioned in the collection forms with an asterisk are mandatory. If they are not filled in, ASTONFLY will not be able to respond to your request.

  1. Recipients or categories of recipients of the data

The data collected by ASTONFLY may be shared with authorised personnel of CLAIR GROUP or its entities or with service providers who provide services useful for the management of your request for information or estimate.

Like ASTONFLY, these service providers undertake to comply with the regulations in force. ASTONFLY requests that all personal data be secured and used only for the purposes defined in the contracts and in accordance with the processing register.

  1. Sharing data with supervisory authorities

Conformément à la réglementation et aux exigences gouvernementales en vigueur, certaines données personnelles peuvent être partagées aux autorités de contrôle à des fins d’immigration, de contrôle frontalier, de sécurité, de sûreté et lutte contre le terrorisme ou à toutes autres fins jugées nécessaires et utiles par les autorités de contrôle.

  1. Transfer of data outside the European Economic Area (EEA)

In order to ensure the performance of certain contracts, some recipients may be established outside the EEA. In this case, personal data is processed with the same level of protection as that processed directly by Clair Group.

  1. Data storage

ASTONFLY shall retain personal data for the time necessary for the purposes defined in the privacy policy and recorded in the group’s processing register, in particular in order to comply with contractual, legal and regulatory requirements. After the defined periods, personal data shall be securely deleted.

  1. Exercising your rights to your personal data

In accordance with the regulations in force, all persons have the right to access their personal data, to request rectification, deletion, portability, to exercise their rights to limit or oppose processing and to determine the fate of their data after death.

In accordance with the regulations in force, CLAIR GROUP has one month to respond to your request. If your request is complex, we will inform you within 30 days that the processing time will be extended to three months.

CLAIR GROUP pays the greatest attention to the protection of personal data. However, if you are not satisfied with the response to your request or if you have any complaints about the data processing carried out, you have the right to appeal to the Commission Nationale de l’Informatique et des Libertés (CNIL).   1. Fighting fraud

ASTONFLY takes all necessary measures and precautions to preserve the security and confidentiality of the data collected, in particular to prevent such data from being distorted, damaged, disclosed or transmitted to unauthorised third parties.

In order to prevent fraud, ASTONFLY has a specific procedure for assessing any violation of personal data, notifying the competent authority within the time limit provided for by the regulations and warning you when this violation is likely to result in a significant risk to you or to affect your private data.
